CLARKSBURG, W.Va. (WV News) — A magistrate on Tuesday found probable cause for wanton endangerment and three other felony charges against a Clarksburg man.
Magistrate Mike Weiss’ decision sends to circuit court the charges against Tyrone Josh Amos of prohibited person in possession of a firearm, entry of a building other than a dwelling, use or presentation of a firearm during commission of a felony, and wanton endangerment.
On Feb. 16, the owner of the small outbuilding where Amos was staying went into the residence with a shotgun after allegedly hearing a report that Amos was threatening to kill a dog and had been throwing things at a female.
The property owner said Amos took the shotgun away and began punching the property owner in face; the property owner ran out and went to his garage, locking it, the property owner told Trooper I.M. Harmon.
The property owner believed Amos fired a shot at the door, and the property owner said he then “grabbed a hunting rifle to defend himself,” according to Harmon. Amos allegedly kicked in the garage door, took the hunting rifle away, and then punched the property owner again in the face, according to Harmon.
Amos then allegedly took the property owner’s cellphone and then left the area, according to Harmon.
Some of the physical evidence was consistent with the allegations by the property owner, according to Harmon.
Amos is prohibited from possessing guns due to prior felony drug convictions, according to Harmon.

— A federal inmate has been sentenced to an extra 6 1/2 years of incarceration for assaulting a correctional officer with physical contact and possessing a weapon.
Northern West Virginia Chief U.S. District Judge Thomas S. Kleeh sentenced Dwight F. Foster, 50, to 63 months for assaulting the officer, and 15 more months for possessing the weapon.
The judge ran the sentences consecutive to time Foster is serving. Foster’s release date is now likely to move from early 2043 to early or mid 2047.
Both crimes occurred Sept. 15, 2021, at USP Hazelton.
According to court documents and statements made in court, during a search of Foster’s prison cell, officers found a prison-made weapon. When a correctional officer attempted to seize the object, Foster struck the officer with his fist, the Office of U.S. Attorney William Ihlenfeld said.
Assistant U.S. attorneys Brandon Flower and Christie Utt represented the government. The Bureau of Prisons investigated.
Assistant federal defenders Beth Gross, Hilary Godwin and Richard Walker made appearances on Foster’s case.
— Chief Judge Kleeh has sentenced John J. Small, 44, to another two years in federal custody for assault on a correctional officer resulting in injury.
Small’s release date currently is Jan. 3, 2133, but that will get pushed back with the additional time.
Small committed the crime Sept. 26, 2022, at USP Hazelton, according to court records.
— Emilee May Burnside, 22, of Clarksburg, has been charged with four counts of felony forgery of a public record.
Burnside forged her sister’s name on official paperwork after being arrested on a charge of misdemeanor possession of a controlled substance, according to Harrison Deputy J.M. Kennedy.
At the time of the alleged forgeries, Burnside was wanted on a bench warrant issued by Harrison Magistrate Warren “Gizzy” Davis. Burnside failed to appear for a revocation hearing in a separate misdemeanor case in which she is on probation for shoplifting, according to court records.
Harrison Magistrate Kimberly Wygal set a $10,000 10/90 or property bond on the new felony forgery of a public record charges.
— Amber Ann Louk, 38, of Rowlesburg, has been charged with misdemeanor battery on a law enforcement officer.
While in custody for an alleged DUI, Louk scratched Deputy R. Knapp’s left arm, left hand and right hand, to the point where he bled in some spots, according to the complaint.
Magistrate Kimberly Wygal set bond at $1,500 10/90 or property.
— Delores Ann Brannon, 49, of Lost Creek, has entered a plea to misdemeanor possession and been sentenced to six months in jail, with credit for nine days served. The plea in Harrison County Magistrate Court resolved a case in which Brannon had been facing a felony drug charge.
