The defense wants a district judge to rule out the possibility of the death penalty for a Hazelton inmate accused in another prisoner's death, with the lawyers citing lack of funding to help their indigent client.
CLARKSBURG — A court-appointed lawyer for a Hazelton inmate accused in the 2007 slaying of another prisoner is citing lack of taxpayer funding in saying his client shouldn’t face the possibility of the death penalty.
The office of U.S. Attorney William J. Ihlenfeld II has given notice previously it will seek the death penalty against inmate Patrick Andrews if he’s convicted in the death of fellow inmate Jesse Harris, 28, on Oct. 7, 2007.
Annapolis, Md., defense attorney Harry J. Trainor Jr.’s motion filed Thursday asks U.S. District Judge Irene M. Keeley to dismiss the government’s capital case notice and allow the case to proceed to trial without death as a possible sentence.
The government already has indicated it won’t seek the death penalty if it convicts 32-year-old codefendant Kevin Bellinger.
Trainor notes that case budget for Andrews, also 32, was submitted for approval nearly six months ago, but no action has been taken.
